When children are soccer players, can their fathers buy betting tickets in Vietnam?

Pursuant to Clause 2, Article 7, Decree 06/2017/ND-CP stipulates that persons not allowed to place bets:

a) Persons not satisfying the requirement specified in clause 1 of this Article;

b) Managers, directors and employees of bet-organizing enterprises and their parents, spouses and children must not place bets through the enterprises they work for;

c) Members of the Race surveillance councils of horse races or greyhound races and their parents, spouses and children must not place bets on the races which are under their surveillance;

d) Jockeys, players, referees and their parent, spouse and children must not place bets on races and soccer matches and tournaments that they participate or control;

dd) Persons whose parents, spouses or children who have fully legal capacity or who themselves request the bet-organizing enterprise to prevent them from placing bets;

e) Persons who are liable to criminal prosecution or have incurred penalties which have not been expunged; persons who are incurring the measure of education at reform schools or rehabilitation centers.

Thus, according to the above regulations in Vietnam, when a child is a football player, the father is not allowed to participate in buying betting tickets. If he still buys them, he will violate the law and be subject to administrative fines.

If any person sells betting tickets to a player's father in Vietnam, will he be fined up to 150,000,000 VND?

According to Clause 1, Clause 3 and Clause 4, Article 12 of Decree 137/2021/ND-CP, violations regarding bettor management stipulate:

1. A fine ranging from 130.000.000 VND to 150.000.000 VND is imposed on selling bet tickets to individuals ineligible for placing bets.

2. A fine ranging from 160.000.000 VND to 180.000.000 VND is imposed on lending bettors money for placing bets.

3. Additional penalties:

a) Suspension of Certificate of eligibility for betting operation for 6 to 12 months for first-time violation under Clause 1 of this Article; 12 to 24 months for subsequent violation under Clause 1 of this Article;

b) Suspension of Certificate of eligibility for betting operation for 6 to 12 months for violations under Clause 2 of this Article.

4. Remedial measures:

Mandated submission of illegal revenues generated by the violations under this Article.

In Clause 2, Article 5, Decree 137/2021/ND-CP stipulates fine levels:

2. Fine, entitlement to impose fine, and entitlement to confiscate exhibits of administrative violations of each title in regard to violations hereunder apply to organization offenders, except for Article 13, Article 31, and Article 45 hereof which only apply to individual offenders. Fine, entitlement to impose fine of each title in regard to individual offender shall equal half of those in regard to organization offender for the same administrative violations hereunder.

Therefore, the act of selling betting tickets to the player's father will be subject to an administrative fine of between 130,000,000 VND and 150,000,000 VND. There is also an additional penalty of deprivation of the right to use the Certificate of eligibility for betting business from 06 months to 12 months for the first violation and from 12 months to 24 months for the 2nd violation or more. Finally, return the illegal profits obtained from selling betting tickets to the player's father in Vietnam.
