Based on Clause 2, Article 5 of Circular 22/2021/TT-BCT (Effective from 01/02/2022) on the issuance, numbering, and time frame for document issuance in the activities of inspection and handling of violations by the Market Surveillance Force, the following regulations are stipulated:
The head of the Market Surveillance Force agency, unit, or the authorized person assigns the task of drafting documents to the designated unit or official, except in cases where the official is directly responsible for drafting and issuing the document according to the law.
The designated unit or official responsible for drafting the document performs the following tasks: determining the type, content, form, and level of confidentiality or urgency of the document; collecting and processing relevant information and drafting the document according to the prescribed form.
Except for the provisions in Clause 3 and Clause 4 of this Article, the content of the document is established and drafted using the corresponding form on a computer or on the Information Management System for Database and Electronic Documents in the activities of inspection and handling of administrative violations and the implementation of operational measures by the Market Surveillance Force (referred to as the INS system) as regulated in Article 8 of this Circular, and printed on A4 paper in the prescribed format and presentation technique.
The head of the drafting unit and the designated official responsible for drafting the document are accountable to the head of the Market Surveillance Force agency, unit, or the authorized person who assigned the task, as well as to the law regarding the content of the document.
The authorized person signing the document must review and approve the document before signing and issuing it, and is responsible for the legal validity of the signed document. Forms with multiple pages, multiple copies, including those with attachments and appendices, must have the signatures of relevant individuals as prescribed in the form on each page, each copy of the form used.
The numbering, identification, and time of issuance of the document are managed and issued for each type of form as regulated in Article 6 of this Circular.
Digital signatures (if applicable), duplication, stamping of the Market Surveillance Force agency or unit, and the indication of the level of confidentiality or urgency; issuance and tracking of document distribution and archiving are carried out in accordance with the regulations on document management and the provisions in Clause 5 of this Article.
