Report on the Implementation of Promotional Programs Sent via Mail?
Pursuant to the regulations at Point a Clause 2 Article 21 of Decree 81/2018/ND-CP:
Within 45 days from the expiry date of awarding prizes of the promotion program in the form as stipulated in Article 13 of this Decree and other forms as stipulated in Clause 9 Article 92 of the Commercial Law 2005, the business that conducts the promotion program must submit a written report to the competent state management agency (where it has been registered and confirmed) on the results of the implementation of the promotion program according to Form No. 07 in the Appendix issued together with this Decree.
As for the method of submitting the dossier, the above regulation does not specify the methods by which businesses can submit the report dossier. However, in reference to the regulations on the method of submitting the dossier for procedures such as registering the implementation of the promotion program, registering for amendments, and supplements to the contents of the promotion program, during the implementation process of promotional activities, the business can choose one of the following methods:
- Submit the registration dossier by mail to the competent state management agency;
- Submit the registration dossier directly at the headquarters of the competent state management agency;
- Use the online public service system provided by the competent state management agency.
The regulation on submitting the report dossier of the implementation of the promotion program above also does not mandate businesses to submit the dossier directly, so businesses can send the report dossier by mail as with other procedures during the promotion process.
Note: Businesses must retain documents and materials related to the report on the results of the implementation of the promotion and are responsible according to the provisions of the law to serve the purpose of inspection, examination, and supervision.
