Who is Responsible for Court Fees in a Unilateral Divorce?
Section 4, Article 147 of the 2015 Civil Procedure Code stipulates the obligation to bear first-instance court fees as follows:
- In a divorce case, the plaintiff must bear the first-instance court fees, regardless of whether or not the Court accepts the plaintiff's request. In the case where both parties mutually consent to the divorce, each party must bear half of the first-instance court fees.
=> According to this provision, the plaintiff will be the one to bear the first-instance court fees in a unilateral divorce. The obligation to bear the court fees does not depend on whether or not the Court accepts the plaintiff's request.
