Who Is Responsible for Court Clerks When Violations Occur?
Pursuant to Article 47 of the 2015 Criminal Procedure Code, the following is stipulated:
- The Court Clerk assigned to conduct proceedings in a criminal case shall have the following duties and powers:
a) Verify the presence of those summoned by the Court; if anyone is absent, he/she must state the reason;
b) Announce the rules of the court session;
c) Report to the Trial Panel the list of those summoned to the court session and those who are absent;
d) Record the minutes of the court session;
e) Conduct other procedural activities within the Court's jurisdiction as assigned by the Chief Justice of the Court.
- The Court Clerk shall be responsible before the law and before the Chief Justice of the Court for his/her actions.
