Who Is Responsible for Court Clerks When Violations Occur?

Pursuant to Article 47 of the 2015 Criminal Procedure Code, the following is stipulated:

1. The Court Clerk assigned to conduct proceedings in a criminal case shall have the following duties and powers:

a) Verify the presence of those summoned by the Court; if anyone is absent, he/she must state the reason;

b) Announce the rules of the court session;

c) Report to the Trial Panel the list of those summoned to the court session and those who are absent;

d) Record the minutes of the court session;

e) Conduct other procedural activities within the Court's jurisdiction as assigned by the Chief Justice of the Court.

2. The Court Clerk shall be responsible before the law and before the Chief Justice of the Court for his/her actions.
