Which Court Has Jurisdiction Over Cases of Death During Military Service?
At Section I of Joint Circular 01/2005/TTLT-TANDTC-VKSNDTC-BQP-BCA, it is specified that the subjects under the jurisdiction of the Military Courts include:
- Active-duty soldiers, including officers, non-commissioned officers, enlisted personnel, and professional soldiers as stipulated in the Law on Military Service, the Law on Officers of the Vietnam People's Army;
- Defense officials include citizens recruited to serve in the Army or transferred from officers and directly managed by military enterprise units in accordance with the law on officials and the Law on Officers of the Vietnam People's Army;
c) Defense workers include:
+ Citizens who are recruited under the payroll of military units and enterprises;
+ Citizens with indefinite-term labor contracts in military units and enterprises, if they commit crimes while performing defense duties under the contract;
- Reserve soldiers during training, exercises, or readiness checks as prescribed by the Law on Mobilization Reserve Force;
- Militia and self-defense forces during their attachment to the Army in combat or combat support as prescribed by law on militia and self-defense forces;
=> Thus, according to the aforementioned regulations, the case of death during military service falls under the jurisdiction of the Military Court.
