Which Cases Do Enforcement Agencies Not Issue a General Enforcement Decision in a Judgment?
According to the provisions of Clause 4, Article 1 of Decree 33/2020/ND-CP (Effective from May 1, 2020), the head of the civil judgment enforcement agency shall issue a single enforcement decision for all items subject to proactive enforcement in a judgment, except for the following cases:
- If there is a person entitled to receive money or property back, a separate enforcement decision shall be issued for that person.
- If a person is obligated to execute multiple different items, a separate enforcement decision shall be issued for that person.
- If a person has both rights and obligations, a separate enforcement decision shall be issued for that person.
Thus, there will be 3 cases where the civil judgment enforcement agency does not issue a single enforcement decision for the items subject to proactive enforcement in a judgment.
