What is the right to propose opinions of detainees and prisoners in the implementation of democracy in the enforcement of provisional detention and detention in Vietnam?

According to Article 8 of Circular 81/2019/TT-BCA, the rights of detainees and prisoners to propose opinions in the implementation of democracy in the enforcement of provisional detention and detention by the People's Police force are as follows:

1. Detainees and prisoners have the right to propose opinions to the staff of the detention facility on issues related to themselves as well as to other detainees and prisoners.

2. Detainees and prisoners have the right to submit petitions about decisions made during the period of provisional detention and detention, complaints, and denunciations in accordance with the law; they have the right to submit petitions to the head of the detention facility about negative manifestations, shortcomings in the management and education of detainees and prisoners by officers and soldiers working at the detention facility; and they have the right to submit petitions about wrongful words, acts, and actions of other detainees and prisoners that violate the law.

3. Detainees and prisoners exercise the right to participate in opinions, petitions, and proposals through suggestion boxes, direct dialogue, or other forms in accordance with the law and this Circular.

What are the responsibilities of the head of a detention facility for the implementation of democracy in the enforcement of provisional detention and detention by the People's Police force in Vietnam?

Pursuant to Article 9 of Circular 81/2019/TT-BCA stipulating responsibilities of the head of a detention facility for the implementation of democracy in the enforcement of provisional detention and detention by the People's Police force in Vietnam as follows:

1. Organize, supervise, and inspect officers and soldiers in the unit to implement and be responsible for the results of implementing the contents stipulated in Articles 4, 5, and 6 of Chapter II of this Circular. Detect, review, and handle officers and soldiers who violate regulations on the implementation of democracy in the management and education of detainees and prisoners.

2. Create favorable conditions for detainees and prisoners and relevant agencies, organizations, and individuals to implement the contents stipulated in Articles 7 and 8 of Chapter II of this Circular.

3. Provide suggestion boxes in the detention area or common areas within the detention facility.
Regularly meet with the public once a month, listen to the feedback of citizens; promptly resolve citizen complaints and denunciations. Timely notify, in writing, and publicly post responses to the resolution of citizen complaints, denunciations, and suggestions.

4. Resolve complaints and denunciations of agencies, organizations, individuals, and detainees and prisoners in accordance with the law.

What are the responsibilities of officers and soldiers at the detention facility for the implementation of democracy in the enforcement of provisional detention and detention in Vietnam?

Pursuant to Article 10 of Circular 81/2019/TT-BCA stipulating responsibilities of officers and soldiers at the detention facility for the implementation of democracy in the enforcement of provisional detention and detention in Vietnam as follows:

1. Strictly implement the provisions of this Circular.

2. Strictly comply with the Police Code of Conduct when contacting and working with agencies, organizations, and individuals.

3. Promptly report to the leadership of the unit any violations of regulations on the implementation of democracy in the management and education of detainees and prisoners.

4. Use the necessary equipment and facilities to serve the work as prescribed.

5. Advise the head of the detention facility on the contents to ensure the implementation of democracy in the work of provisional detention and detention.

6. Do not arbitrarily contact to take advantage of borrowing, begging, buying, selling or receiving money, gifts or embezzlement of gifts of detainees, prisoners and their relatives in any form or bring prohibited items into the detention facility; assist, hide for detainees, prisoners and others violate the regulations of the detention facility, affecting the work of investigation, prosecution, trial and execution. Strictly implement the regulations on preventing torture, persecution, torture, cruel, inhuman, degrading treatment or punishment or any other form of violation of the legitimate rights and interests of detainees and prisoners.
