What Are the Consequences of Violating Courtroom Rules?
Section 2, Article 3 of the Regulations on Court Hearings issued together with Circular 02/2017/TT-TANDTC stipulates as follows regarding the courtroom rules:
Individuals violating the courtroom rules may be subject to different measures by the presiding judge, including being expelled from the courtroom or the trial area, being administratively fined, or being temporarily detained. In cases where the individual's conduct in violating the courtroom rules rises to the level requiring criminal liability, the Trial Council has the authority to initiate a criminal case.
=> In cases of violations of the courtroom rules, the presiding judge may expel the violator from the courtroom or the trial area, impose an administrative fine, temporarily detain them, or initiate criminal proceedings.
