What are regulations on the seizure of valuable papers for the execution of civil judgments in Vietnam?
Currently, the seizure of negotiable instruments for civil judgment enforcement is stipulated in Article 82 of the Law on Civil Judgment Enforcement 2008 with the following content:
- In case the judgment debtor or any agency, organization, or individual is found to be holding negotiable instruments belonging to the judgment debtor, the Enforcement Officer shall issue a decision to seize those instruments for execution of the judgment.
- The judgment debtor or any agency, organization, or individual holding negotiable instruments of the judgment debtor must transfer those instruments to the civil judgment enforcement agency as prescribed by law.
In cases where the judgment debtor or any agency, organization, or individual holding negotiable instruments does not hand over the instruments to the civil judgment enforcement agency, the Enforcement Officer shall request the competent agency or organization to transfer the value of those instruments for judgment enforcement.
