Pursunat to Article 3 of the Regulations on the establishment, management, and use of inspection dossiers for the settlement of civil, family, commercial, and labor cases in the People's Procuracy sector issued together with Decision 264/QĐ-VKSTC in 2022 stipulating principles of establishing, managing, and using inspection dossiers in the People's Procuracy sector in Vietnam as follows:

1. Compliance with the provisions of law, regulations, and guidelines of the Supreme People's Procuracy on the establishment, management, and use of inspection dossiers.

2. Protection of state secrets and the work secrets of the People's Procuracy sector.

3. Ensuring completeness, scientificity, and convenience in the exploitation and use of dossiers.

4. Inspection dossiers must fully and accurately reflect information about civil cases, court decisions, and the activities of the People's Procuracy.

Documents sent to the People's Procuracy by the courts in accordance with the law and documents issued by the People's Procuracy must be original when included in the inspection dossier.

Documents in the inspection dossier must be arranged in chronological order; documents first in time must be placed at the bottom, and documents later in time must be placed at the top and numbered from bottom to top. If the inspection dossier consists of multiple volumes, the documents in each volume must also be arranged in accordance with the above regulations.

5. The dossier must not be lost, misplaced, or damaged.

6. It is strictly prohibited to falsify inspection dossiers, use inspection dossiers for purposes that prosecutors are not allowed to do under Article 84 of the Law on the Organization of the People's Procuracy in 2014 or for other purposes that are not in accordance with the law and the regulations of the People's Procuracy sector.

Pursunat to Article 4 of the Regulations on the establishment, management, and use of inspection dossiers for the settlement of civil, family, commercial, and labor cases in the People's Procuracy sector issued together with Decision 264/QĐ-VKSTC in 2022 stipulating the subject of establishing, managing, and using inspection dossiers in the People's Procuracy sector in Vietnam as follows:

1. The Procuracy, which supervises the resolution of civil cases, is responsible for preparing and managing procuracy records.

If there is an appeal, protest or petition in a civil case, the Procuracy, which supervises the Court's consideration and resolution of the appeal, protest or petition, is responsible for preparing and managing the procuracy file it created. .

2. Civil servants assigned to supervise the resolution of civil cases are responsible for directly preparing supervision records.

3. The prosecutor assigned to supervise the resolution of civil cases is responsible for managing the prosecutor's records until the records are archived or transferred to another person for management.

The prosecutor's records are transferred to the person who has the right to use the records specified in Clause 4 of this Article, then that person is responsible for managing the records.

Pursunat to Article 5 of the Regulations on the establishment, management, and use of inspection dossiers for the settlement of civil, family, commercial, and labor cases in the People's Procuracy sector issued together with Decision 264/QĐ-VKSTC in 2022 stipulating the establishment, management, and use of electronic inspection dossiers in the People's Procuracy sector in Vietnam as follows:

1. Electronic inspection dossiers are established on the basis of digitization of paper documents, image documents, film documents, and audio documents in the civil case dossier of the Court or the paper inspection dossier.

2. The People's Procuracy that has inspected the settlement of a civil case or has established a paper inspection dossier shall carry out the establishment of an electronic inspection dossier.

The People's Procuracy that has established a paper inspection dossier but has not established an electronic inspection dossier and the dossier has been transferred to another People's Procuracy for archiving shall be carried out by the People's Procuracy that has received the dossier for archiving to establish an electronic inspection dossier.

3. Electronic inspection dossiers are prioritized for use if there are both paper and electronic inspection dossiers.

4. The establishment, management, and use of electronic inspection dossiers shall be carried out in accordance with the regulations and guidelines of the Supreme People's Procuracy.
