The Number of Temporary Detention Extensions Requiring Approval from the Procuracy?
Section 2 Article 118 of the Criminal Procedure Code 2015 provides regulations on the duration of custody, specifically:
In necessary cases, the person who issues the custody decision may extend the custody period but not exceeding 03 days. In special cases, the person who issues the custody decision may extend the custody period for the second time but not exceeding 03 days.
All cases of extending the custody period must be approved by the equivalent level Procuracy or the competent Procuracy. Within 12 hours from the receipt of the dossier requesting an extension of the custody period, the Procuracy must issue an approval decision or a non-approval decision.
Thus, according to regulations, in all cases of extending the custody period (regardless of which extension), it must be approved by the equivalent level Procuracy or the competent Procuracy.
