Returning 3/4 of Asset from Bribery will Avoid the Death Penalty?
Point c Clause 3 Article 40 of the Criminal Code 2015 stipulates: The death penalty is not executed for the convicted person if they fall into one of the following cases:
...
A person sentenced to death for embezzlement or taking bribes, who, after being convicted, has proactively returned at least three-quarters of the embezzled or bribe assets and has actively cooperated with the authorities in detecting, investigating, and handling the crime or has made great achievements.
According to this provision, a person sentenced to death for taking bribes will not be executed if they fall into one of the following two cases:
+ Has proactively returned at least three-quarters of the bribery assets and actively cooperated with the authorities in detecting, investigating, and handling the crime;
+ Made great achievements.
Thus, a person sentenced to death for this crime who has returned at least three-quarters of the bribery assets does not yet meet the conditions to avoid the death penalty. In addition to returning the bribery assets, they must actively cooperate with the authorities in detecting, investigating, and handling the crime.
