Mandatory Jury Members Must Be Officers of the Ho Chi Minh Communist Youth Union?
Based on Clause 2, Article 6 of Circular 02/2018/TT-TANDTC, the regulation is as follows:
When resolving a criminal case involving participants under 18 years of age, the Chief Justice of the Court assigns Judges and Jurors who must ensure the following conditions:
- The Judge must have experience in adjudicating cases involving individuals under 18 years of age or have been trained, instructed, and enhanced in skills for resolving criminal cases involving participants under 18 years of age, or have been educated in psychology and educational science concerning individuals under 18 years of age.
- One Juror must be a teacher, a member of the Ho Chi Minh Communist Youth Union, or someone with experience and understanding of the psychology of individuals under 18 years of age.
Thus, in the case of adjudicating a criminal case involving individuals under 18 years of age, it is not mandatory that the Juror be a member of the Ho Chi Minh Communist Youth Union. The Juror can also be a teacher or someone with experience and understanding of the psychology of individuals under 18 years of age.
