Is it permissible to authorize another person to file a complaint?
Based on Clauses 1 and 2, Article 5 of Decree 124/2020/ND-CP, the provisions are as follows:
The complainant may file a complaint themselves or authorize a lawyer, legal aid officer, or another person with full civil capacity to file the complaint. In case the complainant is a minor or a person who has lost civil capacity, their legal representative shall file the complaint. The determination of the representative shall be carried out in accordance with civil law.
Agencies and organizations shall carry out complaints through their legal representatives. The representative of an agency or organization may authorize a lawyer or another person with full civil capacity to file the complaint.
Thus, you have the right to authorize another person to file the complaint on your behalf. However, the person authorized to file the complaint on your behalf must meet the conditions stipulated above.
Is it necessary to notarize the authorization document to file a complaint?
Based on Clause 3 of this Article, the provisions are as follows:
The authorization stipulated in Clauses 1 and 2 of this Article must be in writing and authenticated or notarized. The authorizer can authorize one person or multiple people for different authorized contents but cannot authorize multiple people for one content. The authorization document for the complaint shall be carried out in accordance with Form No. 02 issued together with this Decree.
The authorization document for filing a complaint must be notarized and authenticated.
