Is it possible to withdraw a divorce petition during a court session?
In Clause 4, Article 70 of the Civil Procedure Code 2015, when participating in the proceedings, the litigants have the following rights:
- Maintain, change, supplement, or withdraw their request in accordance with the provisions of this Code.
According to Article 243 of the Civil Procedure Code 2015, the procedure for questioning the litigants about changing, supplementing, withdrawing the request starts with the presiding judge questioning the litigants about the following matters. Including:
- Ask the plaintiff whether they want to change, supplement, or withdraw part or all of the lawsuit request.
And in Clause 2, Article 244 of the Civil Procedure Code 2015, it is stipulated:
Article 244. Consideration of changing, supplementing, withdrawing the request
- In case any litigant withdraws part or all of their request and their withdrawal is voluntary, the Trial Council accepts and suspends the trial concerning the part or all of the request withdrawn by the litigant.
=> Therefore, according to the above-mentioned regulations, during the trial process of a divorce case, the parties have the right to withdraw the lawsuit request for divorce.
