Is it possible to file for divorce by mail?
Section 1, Article 190 of the Civil Procedure Code of 2015 provides regulations on the submission of a lawsuit petition to the Court as follows:
- The plaintiff submits the lawsuit petition along with the documents and evidence they currently possess to the competent Court for case resolution through the following methods:
+ Direct submission at the Court;
+ Submission to the Court by postal service;
+ Online submission via electronic forms through the Court's electronic information portal (if available).
Thus, according to this regulation, you can submit the divorce petition to the court through the postal service.
* Unilateral divorce application dossier
Currently, there is no legal document that specifically prescribes the unilateral divorce application dossier; however, based on practical experience at the Court, you need to prepare the following documents:
- Divorce lawsuit petition;
- Original marriage certificate;
- Certified true copies of the ID card/Citizen Identification Card of both spouses;
- Certified true copies of the household registration book of both spouses;
- Copies of the birth certificates of the children (if any);
- Copies of property documents such as land use rights certificates, savings books,...(if any).
