Expiry of the Statute of Limitations for Criminal Liability Precludes Criminal Prosecution
Pursuant to Clause 5, Article 157 of the Criminal Procedure Code 2015, it is stipulated that no criminal prosecution shall be initiated as follows:
- The person who commits socially dangerous acts is not of the age to bear criminal responsibility;
- The person whose criminal act has been adjudicated or has a legally effective decision to suspend the case;
- The statute of limitations for criminal liability has expired.
Therefore, in cases where the statute of limitations for criminal liability has expired, no criminal prosecution shall be initiated.
