Can ordinary citizens serve as protectors of the rights and legitimate interests of litigants?
Based on Point c Clause 2 Article 61 of the 2015 Administrative Procedure Law, it stipulates as follows:
The following persons are permitted to act as protectors of the rights and legitimate interests of the involved parties, upon the request of the involved parties and registration with the Court to protect the rights and legitimate interests of the involved parties:
- Lawyers participating in proceedings in accordance with the provisions of the law on lawyers;
- ...
- Vietnamese citizens who have full civil act capacity, have legal knowledge, have not been convicted or have been convicted but have had their criminal records expunged, are not currently subjected to administrative handling measures, and are not officials in judicial agencies such as the Court, Procuracy, Inspectorate, Execution agencies; and officials, officers, and non-commissioned officers in the Police department.
Thus, citizens may act as protectors of the rights and legitimate interests of the involved parties. However, this is contingent upon the request of the involved parties and registration with the Court in accordance with the provisions of Point c mentioned above.
