Can drug addicts receive money or gifts from relatives in Vietnam? How many days are drug addicts allowed to return home to mourn their relatives in Vietnam?

My family has a son who is currently undergoing drug treatment at the Provincial drug rehabilitation center. Can my family send money and gifts to my son? If sent, are there any items that are not allowed to be sent to the rehabilitation center?

Pursuant to Article 69 of Decree 116/2021/ND-CP regulating the regime of visiting relatives and receiving money and gifts from drug addicts as follows:

1. Drug addicts are allowed to visit their relatives in the visiting room of the compulsory rehabilitation center, once a week, for no more than 02 hours at a time and for a maximum of no more than 03 relatives. In case of longer meeting, the consent of the Director of the compulsory rehabilitation center must be approved and must not exceed 04 hours.

The drug addict has a spouse who is considered by the Director of the compulsory rehabilitation center and allowed to visit in a private room of the compulsory rehabilitation center once a month and for a maximum of 48 hours for a single visit. Based on the size and conditions, the rehabilitation center builds and organizes a private room for students to visit their spouses.

2. rehabilitation centers develop visitation regulations according to the guidance of the Minister of Labor, War Invalids and Social Affairs.

3. Addicts are allowed to receive and send letters, money, and gifts (except alcohol, beer, cigarettes, stimulants, objects, and prohibited cultural products). Rehabilitation centers are responsible for checking mail and gifts before giving them to drug addicts. As for money or valuable papers, drug addicts must deposit it in the custody department of the compulsory drug rehabilitation center and use it according to the drug rehabilitation center's regulations.

Thus, drug addicts are allowed to receive money and gifts from relatives according to the above regulations. Receiving gifts must be checked by the center before being delivered to the drug addict. Money or valuable papers must be deposited in the custody department of the rehabilitation center and used according to regulations in Vietnam.

How many days are drug addicts allowed to return home to mourn their relatives in Vietnam?

According to the provisions of Article 70 of Decree 116/2021/ND-CP, regulations on mourning regime are as follows:

1. When a parent, spouse, or child dies, the drug addict is allowed to return home to mourn. The maximum time to return for mourning is 05 days, excluding travel time and is included in the time limit for implementing the decision.

2. Procedures for handling mourning regime:

a) The drug addict's family makes a request for the drug addict to come home to mourn, with confirmation from the People's Committee of the commune where the drug addict resides and send it to the Director of the compulsory rehabilitation center. The content of the application must include the following contents: full name, citizen identification number or identity card, place of residence, relationship with the drug addict, proposed time for the drug addict to return home to mourn and commit to managing and supervising drug addicts not to use illegal drugs or commit other violations of the law during the mourning period according to Form No. 48, Appendix II of this Decree.

b) Within 01 day from receipt of the application as prescribed in Clause 1 of this Article, the Director of the drug rehabilitation center is responsible for considering and deciding whether to let the drug addict return home to mourn.

The decision to allow the funeral must include the following contents: full name, time to return for the funeral; The family's responsibility in picking up and returning the drug addict to the rehabilitation center and managing the drug addict during the funeral period. The decision is sent to the drug addict's family and the commune-level People's Committee where that person resides for coordinated management and is stored in the drug addict's file according to Form No. 49, Appendix II of this Decree.

3. The drug addict's family is responsible for welcoming the drug addict home and handing the drug addict back to the compulsory rehabilitation center at the end of the mourning period. All expenses for bringing and picking up the drug addict will be borne by the drug addict's family. The delivery and receipt of drug addicts between the compulsory drug rehabilitation center and the family must be recorded in writing and kept in the drug addict's records.

4. rehabilitation centers must check health and drug use status when receiving drug addicts. In case the time limit for mourning leave has passed and the drug addict does not return to the compulsory rehabilitation center, the Director of the compulsory rehabilitation center must issue a decision to pursue it according to the provisions of law.

According to this Article, drug addicts are allowed to return to their relatives' funerals for 5 days. The mourning period and procedures for handling the mourning regime are carried out according to the above regulations in Vietnam.
