Can a Lawyer Act as a Defender of the Rights and Legal Interests of the Accused?
Based on Clause 2a, Article 83 of the 2015 Criminal Procedure Code, the regulations are as follows:
The protector of the rights and legitimate interests of the accused, or the person whom the initiation of prosecution is recommended, is the person requested by the accused or the person whom the initiation of prosecution is recommended to protect their rights and legitimate interests.
The protector of the rights and legitimate interests of the accused, or the person whom the initiation of prosecution is recommended, may be:
a) Lawyer;
b) People's advocate;
c) Representative;
d) Legal aid provider.
Thus, a lawyer can act as the protector of the rights and legitimate interests of the accused, as stipulated by the aforementioned legal provisions.
