After how many hours must the investigating agency send the decision to prosecute the accused to the Procuracy?
Based on Clause 3, Article 179 of the 2015 Criminal Procedure Code regarding the prosecution of the accused as follows:
Within 24 hours from the issuance of the decision to prosecute the accused, the investigative body must send the decision to prosecute and related documents to the same level Procuracy for approval consideration. Within 3 days from the date of receipt of the decision to prosecute the accused, the Procuracy must decide to approve or decide to cancel the decision to prosecute the accused or request additional evidence and documents as the basis for the approval decision and send it immediately to the investigative body.
In case the Procuracy requests additional evidence and documents, within 3 days from the date of receipt of the additional evidence and documents, the Procuracy must issue a decision to approve or decide to cancel the decision to prosecute the accused.
Thus, within 24 hours from the issuance of the decision to prosecute the accused, the investigative body must send the decision to prosecute and related documents to the same level Procuracy for approval consideration.
