Where to Seek Legal Advice on Surrogacy?
Clause 1, Clause 2 Article 18 of Decree 10/2015/ND-CP stipulates the responsibilities for medical, legal, and psychological counseling in cases of surrogacy as follows:
- Medical examination and treatment facilities authorized to perform surrogacy techniques must organize medical, legal, and psychological counseling for the intending couple and the surrogate mother.
- In cases where the intending couple or the surrogate mother has one of the following Confirmation Certificates, the medical examination and treatment facilities authorized to perform surrogacy techniques are not required to provide counseling on the certified area:
+ A Confirmation Certificate on medical counseling from a doctor working at a medical examination and treatment facility recognized by the Ministry of Health as being authorized to perform in vitro fertilization techniques;
+ A Confirmation Certificate on psychological counseling from an individual with the authority and responsibility to provide psychological counseling, working at a licensed organization with a scope of practice in psychological counseling;
+ A Confirmation Certificate on legal counseling from an individual with the authority and responsibility to provide legal counseling, working at an organization with legal entity status in providing legal assistance and legal advice.
The medical examination and treatment facility authorized to perform surrogacy techniques will organize legal counseling.
