When examining a patient and detecting signs of domestic violence, do doctors have to report it directly to the police in Vietnam? Who pays for examination and treatment costs for patients who are victims of domestic violence in Vietnam? Can I ask the hospital to confirm examination and treatment of a patient who is a victim of domestic violence in Vietnam? 

Hello, I recently took a family member to the hospital. I saw a patient with domestic violence and signs of a crime near my family's bed. So let me ask the doctor to examine the patient. If doctors find out, do they report it directly to the police or do they have to report it to superiors? For patients who are victims of domestic violence, will the examination and treatment costs be paid by the family or by insurance? Please answer.

When examining a patient and detecting signs of domestic violence, do doctors have to report it directly to the police in Vietnam?

Pursuant Article 8 of Circular 24/2017/TT-BYT regulations on detecting acts of domestic violence with criminal signs violates the following:

1. During the process of receiving, screening and providing medical care to patients, if an act of domestic violence with criminal signs is detected as prescribed in Article 2 and Article 8 of the Law on Prevention and Control of Domestic Violence Physicians and medical staff are responsible for reporting to the head of the medical examination and treatment facility.

2. The head of the medical examination and treatment facility is responsible for reporting in writing, by phone or sending someone to directly report the violent act to the nearest police agency or where the patient resides. The family shows signs of crime and requests the police to take measures to support and ensure the safety of victims of domestic violence.

Thus, in case of seeing drugs when examining a patient and detecting domestic violence with signs of crime, it will have to be reported to the head of the medical examination and treatment facility. The head of the medical examination and treatment facility is responsible for reporting in writing, by phone or sending someone to directly report to the nearest police agency or where the patient resides about acts of domestic violence.

Who pays for examination and treatment costs for patients who are victims of domestic violence in Vietnam?

According to Article 11 of Circular 24/2017/TT-BYT regulating examination and treatment costs for patients who are victims of violence Family power is as follows:

1. Expenses for examination and treatment of victims of domestic violence are paid by the Health Insurance Fund for people with health insurance in accordance with the law on health insurance.

2. Expenses for examination and treatment at medical examination and treatment facilities for victims of domestic violence without health insurance must be paid by the victim or their family. Encourage medical examination and treatment facilities to consider exempting and reducing examination and treatment costs at medical examination and treatment facilities for victims of domestic violence in difficult circumstances who cannot pay themselves.

3. Medical examination and treatment facilities can receive support funds from individuals and organizations according to the provisions of law to assist victims of domestic violence at medical examination and treatment facilities. 

Thus, in case the victim has insurance, the costs for examination and treatment of victims of domestic violence will be paid by the Health Insurance Fund according to the provisions of law on health insurance in Vietnam. In case there is no health insurance, the costs will be paid by the victim or his or her family.

Can I ask the hospital to confirm examination and treatment of a patient who is a victim of domestic violence in Vietnam? 

At Article 10 of Circular 24/2017/TT-BYT regulates confirmation of examination and treatment for patients who are victims Domestic violence is as follows:

1. Victims of domestic violence will receive confirmation of examination and treatment from the medical examination and treatment facility if the victim so requests.

2. The medical examination and treatment facility that has received and provided medical care to victims of domestic violence is responsible for issuing a Certificate of examination and treatment of the patient according to the form specified in Appendix No. 2 issued together with this circular.

Thus, victims of domestic violence can ask the hospital for confirmation of examination and treatment in Vietnam. The request for confirmation must be made in accordance with regulations.
