What is the process of alternative care for children?
According to Article 2 Circular 14/2020/TT-BLDTBXH, the process of alternative care for children is as follows:
Receiving and coordinating the handling of information.
Assessing the condition and identifying the support needs of children receiving alternative care.
Identifying children to be received for alternative care.
Receiving information from individuals and families in need of providing alternative care for children.
Verifying and selecting individuals and families for providing alternative care.
Determining individuals and families eligible for providing alternative care.
Developing a plan for support and intervention for children receiving alternative care.
Implementing the support and intervention plan for children in need of receiving alternative care.
Monitoring and assessing the condition of children and individuals and families providing alternative care.
How is the reception and coordination of handling information for alternative care for children regulated?
According to Article 3 Circular 14/2020/TT-BLDTBXH, the reception and coordination of handling information for alternative care for children is regulated as follows:
Social child protection officers at the commune level are responsible for receiving and gathering information about the condition and needs of the children and their family members and preparing a list of children in need of alternative care.
Every 6 months, the head of social assistance establishments is responsible for preparing a list and files of children being cared for at the establishment who are in need of alternative care and submitting them to the Department of Labor - Invalids and Social Affairs, and the district People's Committee for approval as a basis for finding individuals and families to provide alternative care for the children.
The commune-level People's Committee is responsible for receiving the list and files of children in need of alternative care at social assistance establishments approved by the Department of Labor - Invalids and Social Affairs and the district People's Committee, and assigning the social child protection officers at the commune level to manage and implement activities supporting alternative care for the children in accordance with regulations.
Social child protection officers at the commune level are responsible for gathering information about children being abused, at risk of violence, exploitation, abandonment by parents or caregivers, or abused but whose parents or caregivers refuse to implement support and intervention plans, and reporting to the commune-level People's Committee to carry out procedures for temporary alternative care for the children according to Clause 1 Article 32 Decree No. 56/2017/ND-CP dated May 9, 2017, by the Government of Vietnam detailing several articles of the Law on Children (hereinafter abbreviated as Decree No. 56/2017/ND-CP).
