What are regulations on organization of the grassroots fire prevention and fighting team at the headquarters of the Ministry of Health agencies in Vietnam?

Pursuant to Clause 1 and 2, Article 8 of the Regulation on fire prevention, fighting and rescue promulgated together with Decision 3047/QD-BYT in 2022 by the Ministry of Health stipulating organization of the grassroots fire prevention and fighting team at the headquarters of the Ministry of Health agencies in Vietnam as follows:

1. The grassroots fire prevention and fighting team at the head office of the Ministry of Health shall be established, managed and directed by the Chief Office of the Ministry of Health under the decision of the Chief of Office.

a) The payroll of grassroots fire prevention and fighting teams at the headquarters of the Ministry of Health is at least 70 people, including 01 captain and 03 vice captains.

b) The head of the grassroots fire prevention and fighting team at the headquarters of the Ministry of Health is in charge of the Head of the Administration Department of the Office of the Ministry.

c) Vice captains, members of grassroots fire prevention and fighting teams are leaders of the Administration Department, the security team of the Administration Department under the Office of the Ministry, the agency's security forces and other members mobilized from units under the Ministry of Health.

2. The grassroots fire prevention and fighting teams at the units have their own headquarters established, managed and directed by the unit heads. The payroll of grassroots fire prevention and fighting teams at units with separate headquarters shall comply with the provisions of Clause 3, Article 31, Decree No. 136/2020/ND-CP dated November 24, 2020 of the Government stipulating detailing a number of articles and measures to implement the Law on Fire Prevention and Fighting and the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting.

What are duties and powers of grassroots fire prevention and fighting team at the headquarters of the Ministry of Health agencies in Vietnam?

Pursuant to Clause 3 Article 8 of the Regulation on fire prevention, fighting and rescue promulgated together with Decision 3047/QD-BYT in 2022 by the Ministry of Health stipulating duties and powers of grassroots fire prevention and fighting team at the headquarters of the Ministry of Health agencies in Vietnam as follows:

3. Duties and powers of grassroots fire prevention and fighting teams.

a) Formulate the plan, organize the practice of the plan; prepare forces and means and perform fire fighting and rescue tasks in case of fire and explosion.

b) Advise the Chief of Office of the Ministry or the head of the unit (for units with separate headquarters) to promulgate and submit regulations on fire prevention and fighting at the agency or unit.

c) Propagate and disseminate the law and training on fire prevention and fighting in their agencies and units.

d) Inspect and urge the observance of regulations and safety rules on fire prevention and fighting.

dd) Organize and participate in training and retraining of fire prevention and fighting skills.

e) Propose preliminary and summary of activities on fire prevention and fighting and rescue; statistics on fire prevention and fighting work of agencies and units as required.

g) Perform other tasks at the request of the Commanding Board, Heads of Units and competent agencies.

What are regulations on management, preservation and maintenance of vehicles and equipment for fire prevention, fighting and rescue at the headquarters of the Ministry of Health agencies in Vietnam?

Pursuant to Article 9 of the Regulation on fire prevention, fighting and rescue promulgated together with Decision 3047/QD-BYT in 2022 by the Ministry of Health stipulating management, preservation and maintenance of vehicles and equipment for fire prevention, fighting and rescue at the headquarters of the Ministry of Health agencies in Vietnam as follows:

Firefighting and firefighting equipment and facilities must be managed, maintained and repaired in accordance with regulations on management, maintenance and repair of state property to ensure that they are always ready for fire fighting and rescue. The Chief of the Office of the Ministry and the heads of units under the Ministry (for units with their own headquarters) are responsible for directing and assigning management, preservation and maintenance of fire prevention and fighting equipment and devices.

1. Preservation, regular maintenance.

a) Performed daily or before, during and after each use of fire prevention and fighting means and equipment and performed by the person assigned to manage fire prevention and fighting means and equipment.

b) Specific preservation and maintenance contents for fire prevention and fighting vehicles and equipment shall comply with the provisions of Annexes II and VII issued together with Circular No. 17/2021/TT-BCA dated 05/02/2021 of the Minister of Public Security regulating the management, preservation and maintenance of fire prevention and fighting equipment.

2. Preservation, periodical maintenance.

a) Periodic maintenance is carried out monthly at the place where the firefighting and rescue vehicles and equipment are managed or the maintenance facility in accordance with the manufacturer's regulations and by trained personnel.

b) Contents of preservation and maintenance: Check the general technical condition of vehicles and equipment; organize detailed assessment of the quality of means and equipment; Apply the manufacturer's regulations on maintenance and repair levels and the actual situation to have a suitable preservation and maintenance plan for each type of fire prevention and fighting vehicle and equipment.
