When is a Certificate of eligibility for pharmaceutical business in Vietnam reissued?
Based on Article 36 of the Pharmaceutical Law 2016 (amended by Clause 15, Article 1 of the Pharmaceutical Law Amendment 2024) on the issuance, re-issuance, and adjustment of the Certificate of Eligibility for Pharmaceutical Business:
Article 36. Issuance, re-issuance, and adjustment of the Certificate of Eligibility for Pharmaceutical Business
- A Certificate of Eligibility for Pharmaceutical Business is issued in the following cases:
a) The establishment applies for the first-time issuance;
b) The establishment has already been issued a Certificate of Eligibility for Pharmaceutical Business but changes the type of pharmaceutical business establishment or changes the scope of pharmaceutical business which alters business conditions; changes the location of the pharmaceutical business;
c) The establishment has already been issued a Certificate of Eligibility for Pharmaceutical Business but was revoked according to the provisions of Article 40 of this Law.
- A Certificate of Eligibility for Pharmaceutical Business is re-issued in the following cases:
a) The Certificate of Eligibility for Pharmaceutical Business is lost or damaged;
b) The information recorded on the Certificate of Eligibility for Pharmaceutical Business is incorrect due to an error by the issuing agency.
- The Certificate of Eligibility for Pharmaceutical Business is adjusted in the following cases:
a) Changes in the name, address of the business establishment;
b) Changes in the scope of pharmaceutical business without altering the business conditions;
c) Changes in information regarding the person responsible for pharmaceutical expertise recorded in the Certificate of Eligibility for Pharmaceutical Business, except when rotating the person responsible for pharmaceutical expertise between pharmacies in the pharmacy chain.
Thus, the Certificate of Eligibility for Pharmaceutical Business is re-issued in the following cases:
- The Certificate of Eligibility for Pharmaceutical Business is lost or damaged
- Information recorded on the Certificate of Eligibility for Pharmaceutical Business is incorrect due to an error by the issuing agency.
Which establishments does the Director of the Department of Health in Vietnam issue the Certificate of Eligibility for Pharmaceutical Business to?
According to Article 37 of the Pharmaceutical Law 2016 (amended by Clause 16, Article 1 of the Pharmaceutical Law Amendment 2024) on the authority to issue, re-issue, adjust, and revoke the Certificate of Eligibility for Pharmaceutical Business:
Article 37. Authority to issue, re-issue, adjust and revoke the Certificate of Eligibility for Pharmaceutical Business
- The Minister of Health issues, re-issues, adjusts, and revokes the Certificate of Eligibility for Pharmaceutical Business for pharmaceutical business establishments specified at points a, b, c, e, g, h, and i of Clause 2, Article 32 of this Law.
- The Director of the Department of Health issues, re-issues, adjusts, and revokes the Certificate of Eligibility for Pharmaceutical Business for pharmaceutical business establishments specified at points d and đ of Clause 2, Article 32 of this Law.
According to the above regulations, the Director of the Department of Health issues the Certificate of Eligibility for Pharmaceutical Business for the following pharmaceutical business establishments:
- Wholesale pharmaceutical establishments, raw material for medicine
- Retail pharmaceutical establishments including pharmacies, drug counters, medicine cabinets at commune health stations, establishments specializing in retailing medicinal herbs, herbal medicines, traditional medicines
