What are conditions for donation of human organs in Vietnam?

Pursuant to Article 5 of the Law on donation, removal and transplantation of human tissues and organs and the donation and recovery of cadavers in 2006 stipulating the right to donate human tissues and organs and cadavers:

The right to donate human tissues and organs and cadavers

Those who are full eighteen years or older and have full civil act capacity are entitled to donate human tissues and organs when they are living or after their death and to donate their cadavers.

As above regulations, conditions for donation of human organs in Vietnam are:

- Full eighteen years or older;

- Have full civil act capacity;

In addition, following principles shall be ensured when registering donation of human organs:

- Voluntariness of donors and transplant recipients.

- For humanitarian purposes, medical treatment, lecturing or scientific research.

- For non-commercial purposes.

- Confidentiality of information relating to donors and transplant recipients, unless otherwise agreed upon by the involved parties or provided for by law.

What is the financial support for the relatives of organ donors after their death in Vietnam?

According to Article 3 of Circular 104/2017/TT-BTC, the organization of funeral ceremonies and preservation of remains for individuals who donate body parts after death or donate their bodies are stipulated as follows:

Funeral and preservation of remains for individuals who donate body parts after death or donate their bodies

1. In cases where the relatives of individuals who donate body parts after death or donate their bodies have the need to organize funeral ceremonies and preserve the remains, they shall be supported with a funeral fee equivalent to 10 months of the basic salary. The relatives must present the necessary documents proving their relationship to the deceased body donor to the medical facility responsible for receiving and preserving the body in order to receive the funeral and preservation services as stipulated in this provision.

The medical facility responsible for receiving and preserving the body of the donor shall be reimbursed for the actual expenses incurred for the funeral and preservation services, up to a maximum of 10 months of the basic salary.

Therefore, the relatives of organ donors after death are entitled to a funeral support payment equivalent to 10 months of the basic salary, which amounts to 18,000,000 Vietnamese dong (based on the assumption that the statutory pay rate is 1,800,000 Vietnamese dong per month).

What are benefits of donors from whom tissues or organs have been removed in Vietnam?

Pursuant to Article 17 of the Law on donation, removal and transplantation of human tissues and organs and the donation and recovery of cadavers in 2006 stipulating benefits of donors from whom tissues or organs have been removed:

1. Donors are entitled to free health care and rehabilitation right after their tissues are removed at medical establishments;

2. Donors from whom organs have been removed are entitled to the following benefits:

a/ Free health care and rehabilitation right after their tissues are removed at medical establishments and free regular health checks;

b/ Free health insurance cards;

c/ Prioritized transplantation of human tissues or organs at the prescription of a medical establishment;

d/ Receipt of a For the People's Health medal according to regulations of the Minister of Health.

As regulations above, benefits of donors from whom tissues or organs have been removed in Vietnam are:

- Donors are entitled to free health care and rehabilitation right after their tissues are removed;

- Donors from whom organs have been removed are entitled to the following benefits:

+ Free health care and rehabilitation right after their tissues are removed at medical establishments and free regular health checks;

+ Free health insurance cards;

+ Prioritized transplantation of human tissues or organs at the prescription of a medical establishment;

+ Receipt of a For the People's Health medal according to regulations of the Minister of Health.
