How long is the probation period for doctors?
According to the provisions of Article 21 of Decree 115/2020/ND-CP, the regulations are as follows:
Probation Regime
Those who are recruited into public employee positions must undergo probation policies to familiarize themselves with the working environment and perform the jobs for the hired positions.
The probation period is regulated as follows:
a) 12 months for recruitment into professional titles requiring university-level education standards. Specifically, for the professional title of a doctor, it is 09 months;
b) 09 months for recruitment into professional titles requiring college-level education standards;
c) 06 months for recruitment into professional titles requiring intermediate-level education standards.
d) The period of maternity leave according to social insurance benefits, sick leave from 14 days or more, unpaid leave, time of temporary detention, custody, suspension according to the law, is not counted into the probation period.
In case the probationer takes sick leave or has a justifiable reason for less than 14 days and is approved by the head of the public service provider where the recruit is undergoing probation policies, this period is counted into the probation period.

Under what circumstances are doctors exempt from probation?
According to the provisions of Clause 5, Article 21, Decree 115/2020/ND-CP, as amended by Clause 12, Article 1, Decree 85/2023/ND-CP, doctors are exempt from probation if they meet the following conditions:
- Assigned to work in accordance with the specialized training and the expertise and duties of the previously held position;
- The working period on the specialized professional tasks previously performed in accordance with the law, with mandatory social insurance contributions (if not continuous, aggregable), equal to or greater than the corresponding probation period as stipulated in Clause 2, Article 21, Decree 115/2020/ND-CP.
In case the conditions in point a, Clause 5, Article 21, Decree 115/2020/ND-CP are met but the time is not sufficient as prescribed in point b, Clause 5, Article 21, Decree 115/2020/ND-CP, the working period will be subtracted from the probation period as regulated.
What policies do doctors receive during the probation period?
According to Article 23 of Decree 115/2020/ND-CP, as amended and supplemented by Clause 13, Article 1, Decree 85/2023/ND-CP, the policies for probationary doctors are as follows:
- During the probation period, doctors receive 85% of the salary of grade 1 of the professional title recruited.
If a doctor has a higher educational qualification than required for the recruitment position, each higher level of education is added one salary grade, and they receive 85% of the salary coefficient of the assigned grade. Allowances are received according to the law.
- Doctors receive 100% of the salary and allowances of the professional title corresponding to the stipulated educational level in Clause 1, Article 23, Decree 115/2020/ND-CP, in the following cases:
+ Working in areas with particularly difficult socio-economic conditions;
+ Working in hazardous, dangerous industries;
+ Completing military obligations; participation in the people's police force; military officers, police officers, professional soldiers demobilized, personnel in cryptographic work transferring to civil sectors, graduates from officer training programs, graduates from military command training programs for communal military commanders awarded reserve officer ranks who have registered in the reserve officer list, young volunteers, young intellectuals particularly participating in rural, mountainous development from 24 months or more who have completed their tasks.
- The probation period is not counted as the time for considering salary grade promotion.
- Additionally, during the probation period, doctors enjoy bonus policies and other welfare benefits (if any) according to state regulations and the public service provider's regulations.
