The company only accepts medical examination certificates valid for 6 months – is this lawful?
Clause 3 Article 8 Circular 14/2013/TT-BYT stipulates the validity of the Health Certificate, periodic health examination results as follows:
- The Health Certificate (Health check-up certificate) is valid for 12 (twelve) months from the date of the health conclusion signing; For health check-ups for Vietnamese people to work abroad under contracts, the validity of the Health Certificate is in accordance with the regulations of the country or territory where the Vietnamese worker is employed;
- Periodic health examination results are valid according to the provisions of the law.
=> According to this regulation, the health check-up certificate is valid for 12 months from the date of the health conclusion signing.
If your health check-up certificate is dated September 1, 2019, it will expire on September 1, 2020. As of now, it is still valid.
Therefore, the company's acceptance of the health check-up certificate with a validity of only 6 months is not in accordance with the law.
