According to Clause 2, Article 21 of Decree 10/2015/ND-CP, the regulations on storing sperm, oocytes, and embryos are as follows:

2. In the case where the individual who stored sperm, oocytes, or embryos passes away, and the storage facility receives a notification along with a legal copy of the death certificate from the individual's family, the facility must destroy the sperm, oocytes, or embryos, except in cases where the spouse of the deceased submits a request for continued storage and continues to pay the storage and preservation fees.

Thus, based on the current regulations, if sperm is stored at the hospital, it can be kept after the individual’s death if the spouse submits a request for continued storage and continues to pay the storage and preservation fees.

Can the identity of a sperm donor be concealed if the sperm is donated to the hospital?

According to Clause 5, Article 21 of Decree 10/2015/ND-CP, the regulations regarding sperm donors who wish to donate to the storage facility are as follows:

5. If individuals who stored sperm, oocytes, or embryos wish to donate them to the storage facility for others, the facility must use encryption measures to encode the donor's information. If the donation is for the purpose of scientific research, the information does not need to be encrypted.

If a sperm donor wishes to donate to the hospital, their identity information will be encoded.
