Is It Mandatory for Human Organ Donors to Undergo HIV Testing Before Donation?

Is it mandatory for a person donating human organs to undergo an HIV test before donation? How are the costs of mandatory HIV testing for organ donors regulated?I am preparing to register for organ donation, but I have some concerns. May I ask whether it is mandatory to undergo an HIV test before donating organs? And who will bear the cost of this test? Thank you!

Are individuals donating human body parts required to undergo mandatory HIV testing before donating?

Pursuant to Article 1 of Circular 33/2011/TT-BYT, amended by Point b, Clause 2, Article 13 of Circular 01/2015/TT-BYT, the cases required to undergo mandatory HIV testing for diagnosis and treatment are as follows:

1. Individuals donating tissues, human body parts.

  1. Individuals receiving tissues, human body parts.

  2. Individuals donating sperm, eggs.

  3. Individuals receiving sperm, eggs, embryos.

How are the costs for mandatory HIV testing of individuals donating human body parts regulated?

According to Clause 1, Article 3 of the above Circular, the funding for mandatory HIV testing is regulated as follows:

  1. HIV testing costs for cases stipulated in Clause 1, Clause 3, Article 1 of this Circular:

a) In the case of individuals donating tissues, human body parts, donating sperm, eggs (hereafter referred to as the donor) who already have a recipient: The HIV testing costs of the donor shall be covered by the facility receiving the tissues, human body parts, or receiving the sperm, eggs, and these costs shall subsequently be included in the medical examination and treatment costs for the recipient of the sperm, eggs;

b) In the case of donors who do not have a recipient: The HIV testing costs of the donor shall be borne by the facility receiving the tissues, human body parts, or receiving the sperm, eggs. These costs will then be included in the price of the tissue, organs, or the services cost of reproductive assistance techniques provided by the facility, based on the principle of ensuring cost recovery.

Accordingly, if an individual donating human body parts already has a recipient, the HIV testing costs will be borne by the facility receiving the body parts and then will be included in the medical examination and treatment costs for the recipient. If there is no recipient, the HIV testing costs will be covered by the facility receiving the body parts and then included in the service charges for organ transplantation at that facility based on the principle of ensuring cost recovery.
