If he/she does not work in the pharmaceutical field for 4 years, will his/her pharmacy practice certificate be revoked in Vietnam?

Pursuant to Clause 8, Article 28 of the Law on Pharmacy 2016, the cases of revocation of pharmacy practice certificates are as follows:

1. The pharmacy practice certificate is issued ultra vires.

2. The holder of the pharmacy practice certificate requests its revocation.

3. The pharmacy practice certificate is incorrect because of the issuing authority.

4. The application for the pharmacy practice certificate contains counterfeit documents.

5. A person has more than one pharmacy practice certificate.

6. The holder of a pharmacy practice certificate rents it, lends it, leases it, borrows it or allows another person to use it.

7. A person issued with the pharmacy practice certificate fails to satisfy any of the conditions for issuance of the pharmacy practice certificate specified in Article 13 or Clause 2 Article 14 hereof.

8. A person issued with the pharmacy practice certificate fails to practice for 12 consecutive months.

9. A pharmacy practitioner does not have the certificate of completion of training program and refresher program in pharmacy within 03 years from the issuance date of the pharmacy practice certificate or the issuance date of the latest certificate of completion of training program and refresher program in pharmacy.

10. The certificate holder violates the code of ethics for pharmacy practitioners and causes harm to other people’s health or life.

11. A person has had his/her pharmacy practice certificate revoked more than once for the same violation.

Therefore, you were granted a pharmacy practice certificate in Vietnam in September 2017, but since then you have been inactive, the period of non-existence has lasted more than 12 months, so your certificate has been revoked in accordance with Clause 8 of the above Article.

Procedures for revoking pharmacy practice certificates in Vietnam

Pursuant to Article 7 of Decree 54/2017/ND-CP on revocation of pharmacy practice certificates as follows:

1. When a pharmacy practice certificate is revoked according to Clauses 1, 4, 5, 6, 7, 8, 9, 10, 11 Article 28 of the Law on Pharmacy:

Within 05 working days from the day on which the proposal to revoke the pharmacy practice certificate is received or from the discovery of the cases mentioned in Clauses 1, 4, 5, 6, 7, 8, 9, 10, 11 Article 28 of the Law on Pharmacy, the issuing authority shall revoke the pharmaceutical practice certificate it issued, or respond the proposing authority and provide explanation if such proposal is rejected.

2. When a pharmacy practice certificate is revoked according to Clause 2 and Clause 3 Article 28 of the Law on Pharmacy:

Within 05 working days from the day on which the pharmacy practice certificate is found erroneous or the request for revocation of the pharmacy practice certificate is received, the issuing authority shall revoke the pharmaceutical practice certificate it issued, or respond the requesting entity in writing and provide explanation if such request is rejected.

3. Responsibilities of the issuing and revoking authority:

a) Issue the decision to revoke the pharmacy practice certificate;

b) Post such decision on its website and send it to the Ministry of Health and other Departments of Health nationwide;

c) Update information about revocation of the pharmacy practice certificate on its website;

d) The Ministry of Health and Departments of Health of provinces shall post the decision on revocation of the pharmacy practice certificate on their websites within 05 working days from the day on which it is received from its issuer.
