Does the Chief Inspector of the Department have the authority to impose sanctions in the field of health?
According to Clause 2, Article 104 of Decree 117/2020/ND-CP stipulating the authority to sanction administrative violations of the Chief Inspector of the Department in the field of health as follows:
- Issue a warning;
- Impose a fine of up to 15,000,000 VND for administrative violations related to population; up to 25,000,000 VND for administrative violations related to preventive medicine and HIV/AIDS prevention and control; up to 37,500,000 VND for administrative violations related to health insurance; up to 50,000,000 VND for administrative violations related to medical examination and treatment, pharmaceuticals, cosmetics, and medical equipment;
- Revoke licenses, practice certificates for a definite period or suspend activities for a definite period;
- Confiscate exhibits and means of administrative violations valued not exceeding the fine for each field specified in point b of this clause;
- Apply remedial measures as stipulated in points c, d, dd, e, g, h, and i of Clause 1, Article 28 of the Law on Handling Administrative Violations and Clause 3, Article 3 of this Decree.
