Does the business of functional foods require a permit from the Food Safety Department?
According to the provisions at Point d Clause 1 Article 12 of Decree 15/2018/ND-CP, small-scale food business establishments are not subject to the issuance of the Certificate of Food Safety Compliance.
According to Clause 10 Article 3 of this Decree, a small-scale food business establishment is defined as an establishment operated by an individual, group of individuals, or household that registers as a household business and is not issued a Business Registration Certificate, Business Registration Enterprise Certificate, or Investment Certificate according to the provisions of law.
Therefore, if your establishment does not have a Business Registration Certificate, Business Registration Enterprise Certificate, or Investment Certificate, it is not subject to the issuance of the Certificate of Food Safety Compliance.
In this case, you do not need to apply for a Certificate of Food Safety Compliance but must comply with the food safety conditions stipulated in Clause 1 Article 22 of the Food Safety Law 2010.
