Hello. In the near future, I plan to open a street food vendor. Let me ask, do street food sellers need certificates of food safety? What are the conditions to ensure food safety when selling street food?

Do selling street food require certificates of food safety in Vietnam?
Article 12 of Decree 15/2018/ND-CP stipulates exemption from the certificate of food safety as follows:
1. The following entities are not required to obtain the certificate of food safety:
a) Micro food manufacturers;
b) Mobile food manufacturers and sellers;
c) Micro food processors;
d) Micro food sellers;
dd) Sellers of prepackaged foods;
e) Manufacturers and sellers of instruments and materials for wrapping and storing food;
g) Restaurants within hotels;
h) Industrial kitchens not registered as a food business;
i) Street food vendors;
k) Any food business that has one of the following certificates: GMP, HACCP, ISO 22000, IFS, BRC, FSSC 22000 or an equivalent certificate.
2. The entities mentioned in Clause 1 of this Article must satisfy corresponding food safety requirements.
Thus, selling street food is one of the subjects that does not need a certificate of food safety. When you sell street food, you do not need to apply for a certificate of food safety in Vietnam.

What are conditions to ensure food safety when selling street food in Vietnam?
Article 31 of the 2010 Food Safety Law stipulates food safety assurance conditions for street food display places as follows:
1. To be separated from toxic and contaminating sources.
2. To display food on tables, shelves or means which meet requirements on food hygiene and safety and street landscape.
Article 32 of the 2010 Food Safety Law stipulates food safety assurance conditions for food materials and containers, eating utensils, food containers and street vendors as follows:
1. Materials for processing street food must meet food safety requirements and have clear source and origin.
2. Eating utensils and food containers must be hygienically safe.
3. Packages and materials in direct contact with food must neither contaminate nor release contaminants into food.
4. To have devices to prevent sunshine, rain, dust, insects and harmful animals.
5. To sufficiently have technically qualified water for food processing and trading.
6. To comply with regulations on health, knowledge and practices of persons directly engaged in food production and trading.
Above are the conditions to ensure food safety when selling street food according to the provisions of law in Vietnam.
What are conditions to receive certificates of food safety in Vietnam?
Article 34 of the 2010 Food Safety Law stipulates establishments and conditions for the grant and withdrawal of certificates of food safety eligibility as follows:
1. An establishment shall be granted a certificate of food safety eligibility when it fully meets the following conditions:
a/ Having adequate conditions for assuring food safety suitable to each type of food production and trading as prescribed in Chapter IV of this Law;
b/ Having registered for food production and trading as indicated in its business registration certificate.
2. An organization or individual shall have its/his/her certificate of food safety eligibility withdrawn when it/he/she no longer satisfies all conditions prescribed in Clause 1 of this Article.
3. The Government shall specify establishments not subject to the grant of certificates of food safety eligibility.
According to this Article, individuals who want to be granted a certificate of food safety must meet the above conditions according to the law in Vietnam.
