Can a 2-Month Mandatory Rehabilitation with Good Conduct Be Considered for a Reduction in the Rehabilitation Term?

Could you please provide information regarding my husband, who has been undergoing mandatory rehabilitation for 2 months with a set duration of 1 year? If he demonstrates good behavior during the rehabilitation process, is there a possibility of an early release? Thank you.

According to Clause 1, Article 19 of Decree 221/2013/ND-CP stipulating the reduction of the term, temporary suspension, or exemption from serving the remaining time at a compulsory detoxification center as follows:

- Trainees who have served half of the term of the decision to apply the measure of being sent to a compulsory detoxification center, if they show significant progress or perform acts of merit, shall be considered for partial reduction or exemption from serving the remaining time.

+ Trainees who show significant progress are those who strictly comply with the rules, regulations, and detoxification procedures at the center, actively work, study, participate in the center's general movements, and are recognized by the Reward and Discipline Council of the compulsory detoxification center (hereinafter referred to as the Council).

+ Trainees performing acts of merit are those who bravely save lives, save state, collective, or another person's property, and are rewarded by the Director of the compulsory detoxification center; have valuable technical improvement initiatives in labor and production, recognized by competent agencies at the provincial level or higher; have particularly excellent achievements in the People's movement to protect national security and are awarded certificates of merit by the Police or the People's Committee at the district level or higher.

According to the above regulation, your husband would be considered for a partial reduction of the compulsory detoxification term (early release) if he simultaneously meets the following conditions:

- Your husband has served half of the term of the decision to apply the measure of being sent to a compulsory detoxification center;

- Shows significant progress or performs acts of merit.

According to the information you provided, your husband has served only 2 months of the 1-year term (12 months) - which is not half of the term of the decision to apply the measure of being sent to a compulsory detoxification center. Therefore, he does not yet meet the conditions to be considered for a reduction of the compulsory detoxification term.
