Are school healthcare workers entitled to professional incentives?
Pursuant to Article 1 of Decree 56/2011/ND-CP regulating the scope of adjustment and subjects of application as follows:
This Decree provides policies for professional incentive allowances for officials and public employees, health officers at communal, ward, and town levels (working under contractual policies according to Decision No. 58/TTg dated February 03, 1994, of the Prime Minister of the Government of Vietnam on certain organizational issues and policies for grassroots healthcare) directly engaging in healthcare; officials and public employees involved in management and support tasks not directly engaging in healthcare at specialized fields such as HIV/AIDS, leprosy, tuberculosis, mental health, pathology, forensic medicine (hereinafter referred to collectively as officials and public employees) in public healthcare institutions.
This Decree does not apply to healthcare professionals of the armed forces.
In addition, Clause 6 of Article 6 of Decree 56/2011/ND-CP specifies the level of professional incentives for officials and public employees not directly engaging in professional healthcare as follows:
For officials and public employees not directly engaging in professional healthcare; healthcare officials and public employees involved in management and support tasks in public service providers in general healthcare institutions (excluding the subjects stipulated in point b of Clause 5 of this Article), healthcare professionals in agencies, units, or schools, the head of the unit shall, based on the specifics of the job and sources of revenue, consider and decide, but not exceeding 20% of the current salary grade, rank, and position allowance, seniority allowance beyond the framework (if any) of the entitled individual.
Therefore, according to current regulations, healthcare staff are entitled to professional allowances based on the specifics of the job and sources of revenue, as decided by the head of the unit, but not exceeding 20%, regardless of having a professional certificate. As such, in some cases, school healthcare workers without a professional certificate may still receive this incentive.
Calculation of professional incentive allowances
According to Clause 1 of Article 5 Joint Circular 02/2012/TTLT-BYT-BNV-BTC on the method of calculation as follows:
a) The professional incentive allowance is calculated based on the current salary grade, the rank including the position allowance, and the seniority allowance beyond the framework (if any), determined by the following formula:
Money amount of professional incentive allowance received = General minimum salary x [Current salary grade coefficient + position allowance coefficient (if any) + % (converted to coefficient) seniority allowance beyond the framework (if any)] x Professional incentive allowance rate received
