Amendments and supplements to regulations on flavors used in food from November 9, 2023 in Vietnam

On September 25, 2023, the Ministry of Health of Vietnam issued Circular 17/2023/TT-BYT amending, supplementing, and repealling a number of legal documents on food safety issued by the Minister of Health.

As prescribed in Clause 4 Article 5 of Circular 24/2019/TT-BYT stipulating the use of flavors in food before November 9, 2023 as follows:

List of permitted food additives and maximum use levels in food

1. Pursuant to this Circular, the List of permitted food additives is attached at Appendix 1.

2. Pursuant to this Circular, the Maximum use levels of food additives in food are attached at Appendix 2A and Appendix 2B.

3. Pursuant to this Circular, the List of food additives and food products used in accordance with GMP is attached at Appendix 3.

4. Flavors used in food include flavors that have been evaluated by JECFA and determined to be safe at anticipated intake levels or acceptable daily intake levels (ADI). These flavors must meet the corresponding technical requirements for identification and purity; comply with the regulations in National Standard TCVN 6417:2010 on Guidelines for the use of flavors and specific regulations in this Circular.

As prescribed in Clause 2 Article 1 of Circular 17/2023/TT-BYT (effective from November 9, 2023) amending the regulations on flavors used in food as follows:

2. Amendments to Clause 4 of Article 5:

"4. Flavors used in food include flavors that belong to one of the following categories:

a) Flavors that have been evaluated by JECFA and determined to be safe at anticipated intake levels or acceptable daily intake levels (ADI);

b) Flavors that have been Generally Recognized As Safe (GRAS) published by the Flavor and Extract Manufacturers Association of the United States (FEMA);

c) Flavors used in food of the European Union published by the European Parliament and the Council of the European Union."

As regulations above, flavors used in food in Vietnam include:

- Flavors that have been evaluated by JECFA and determined to be safe at anticipated intake levels or acceptable daily intake levels (ADI);

- Flavors that have been Generally Recognized As Safe (GRAS) published by the Flavor and Extract Manufacturers Association of the United States (FEMA);

- Flavors used in food of the European Union published by the European Parliament and the Council of the European Union.

Implementing food safety inspection according to plan up to 01 time/year from November 9, 2023 in Vietnam

Pursuant to Article 7 of Circular 48/2015/TT-BYT stipulating food safety inspections according to plan as follows:

3. Inspection frequency:

a) For food service businesses and street food businesses, follow the regulations set forth in Article 9 of Circular 30/2012/TT-BYT dated December 5, 2012 of the Minister of Health on food safety conditions for food service businesses and street food businesses.

b) For food production and trading establishments under the management of the Ministry of Health, follow the regulations set forth in Article 14 of Circular 16/2012/TT-BYT dated October 22, 2012 of the Minister of Health on food safety conditions for food production and trading establishments, utensils, packaging materials, and food containers under the management of the Ministry of Health.

According to Clause 6, Article 5 of Circular No. 17/2023/TT/BYT on the amendment and supplementation of Clause 3, Article 7 of Circular 48/2015/TT-BYT on the inspection activities of food safety in production and trading of food under the management of the Ministry of Health:

6. Amendment and supplementation of Clause 3 as follows:

3. The frequency of scheduled inspections shall not exceed 1 time per year, except for the case of sudden inspection prescribed in Article 8 of this Circular.

Therefore, according to the new regulations of Circular 17/2023/TT/BYT, the frequency of scheduled food safety inspections will not divide the inspection objects into 2 objects: food service businesses and street food businesses and food production and trading establishments under the management of the Ministry of Health.

According to the new regulations, the frequency of scheduled inspections will not exceed 1 time per year, except for the case of sudden inspection.

When will the new frequency of food safety inspection be applied in Vietnam?

According to Article 10 of Circular 17/2023/TT/BYT stipulating the effective date of implementation as follows:

Effective date of implementation

This Circular takes effect on November 9, 2023.

Therefore, the application of a frequency of 1 time/year for scheduled food safety inspections will begin on November 9, 2023.
