What is the responsibility of the District People's Committee in the demand for environmental damage compensation?
According to Article 131 of the Law on Environmental Protection 2020 (Effective from January 1, 2022) stipulating the responsibilities for claiming compensation for damage and determining environmental damage as follows:
People's Committees at all levels, organizations, and individuals who detect signs of environmental pollution or degradation shall notify the responsible authorities for compensation claims and organize the collection and assessment of data and evidence to determine environmental damage due to pollution and degradation as stipulated in Clause 2 of this Article.
The responsibilities for claiming compensation and organizing the collection and assessment of data and evidence to determine environmental damage due to pollution and degradation are stipulated as follows:
...
b) The district-level People's Committee is responsible for claiming compensation for damages and organizing the collection and assessment of data and evidence to determine environmental damage caused by pollution and degradation occurring in areas spanning two or more commune-level administrative units; organizing the collection and assessment of data and evidence to determine environmental damage due to pollution and degradation at the suggestion of the commune-level People's Committee;
