What are the financial sources for the Disaster Prevention Fund in Vietnam?
According to Article 10 of the Law on Natural Disaster Prevention and Control 2013 as amended in points a and b, clause 7, Article 1 of the Law on Natural Disaster Prevention and Control and Amended Law on Dykes 2020 stipulating the Disaster Prevention Fund in Vietnam:
Article 10. Disaster Prevention Fund
1. The Disaster Prevention Fund is an out-of-budget state financial fund including the central Disaster Prevention Fund managed by the Ministry of Agriculture and Rural Development and the provincial Disaster Prevention Fund managed by the Provincial People's Committee.
2. The financial sources of the Disaster Prevention Fund are stipulated as follows:
a) The financial sources of the central Disaster Prevention Fund include support, voluntary contributions from domestic and foreign organizations and individuals; allocation from provincial Disaster Prevention Funds as decided by the Prime Minister of the Government of Vietnam and other lawful sources;
b) The financial sources of the provincial Disaster Prevention Fund include support, voluntary contributions from domestic and foreign organizations and individuals; mandatory contributions from domestic and foreign economic organizations within the locality, Vietnamese citizens from 18 years old to retirement age under normal working conditions as prescribed by labor laws; allocation from the central Disaster Prevention Fund, between provincial Disaster Prevention Funds and other lawful sources.
3. The Disaster Prevention Fund is used to support disaster prevention activities and prioritize the following activities:
a) Emergency relief regarding food, drinking water, medicine, and other urgent needs for victims of disasters;
b) Support for repairing housing, medical facilities, schools;
c) Sanitation treatment for disaster-affected areas.
4. The principles of operation of the Disaster Prevention Fund are stipulated as follows:
a) Non-profit;
b) Management and use for the right purpose, in accordance with the law, promptly, efficiently, ensuring publicity, transparency;
c) Support disaster prevention activities that the state budget has not invested in or has not met the requirements.
