Pursuant to Article 6 of Circular 55/2022/TT-BQP guiding procedures for implementation of preferential regimes for People's Armed Forces Hero while in military service as follow:

1. Agencies and units of regimental level or higher, within 10 days from the date of receipt of all the papers specified in Clause 1, Article 32 of the Decree , are responsible for examining, approving and certifying copies of documents. declare and send a written request to the immediate superior for inspection and approval according to decentralization (division level and equivalent within 5 days; agencies and units under the Ministry within 05 days), send it to the Department Policy.

2. The Policy Department within 10 days from the date of receipt of a complete dossier as prescribed, shall appraise it; to request the Head of the Political Bureau to issue a decision on preferential subsidies according to Form No.58, Appendix I of the Decree; transfer the dossier together with the decision to the requesting agency or unit for management and implementation of the incentive regime.

What is guidance on process of recognition of war invalids for servicemen and employees of the Government Cipher Committee who are in military service in Vietnam? 

Pursuant to Article 7 of Circular 55/2022/TT-BQP guiding Process of recognition of war invalids and beneficiaries of policies as war invalids (hereinafter referred to as war invalids) for military personnel, defense workers and employees, and people working in cipher organizations under the Political Cipher Committee Government is in military service as follows:

1. When military personnel, defense employees, and people working in medical institutions under the Government Medical Committee are injured: Agencies and units directly managing the wounded at regimental level and equivalent or higher, is responsible for examining, establishing and completing the papers specified in Article 37 of the Decree ; within 9 days from the date of completion of the above documents, issue a certificate of injury according to Form No. 35 Appendix I Decree (hereinafter referred to as certificate of injury) and a document enclosed with a dossier requesting the immediate superior to inspect and approve it according to decentralization (division level and equivalent within 3 days; , unit under the Ministry within 03 days), sent to the Policy Department.

3. The Political Department of the military zone within 03 days from the date of receipt of the dossier and notification of appraisal results from the Policy Department, shall issue a recommendation letter in case of eligibility, enclosed with a copy. file to the competent Medical Assessment Council to determine the rate of bodily injury due to injury.

4. Medical assessment councils at all levels, according to their decentralization, within 45 days from the date of receipt of all required papers, are responsible for organizing injury assessment according to the standards specified in Clause 1 of this Article . In case the results of injury assessment have injuries requiring the use of assistive devices, orthopedic tools, orthopedic rehabilitation means and equipment as prescribed, the Director of the Hospital where the Assessment Council is held medical staff, is responsible for issuing examination papers and appointing the use of assistive devices, orthopedic instruments, orthopedic devices and devices for rehabilitation to subjects according to Form No. 40, Appendix I of the Decree.

The Medical Assessment Council of the Ministry of National Defense and the Medical Assessment Council of Military Hospital 175 shall carry out the examination and rebuttal according to the regulations of the Minister of National Defense for the subjects of examination and assessment.

5. Commander or political commissar of the military zone (subject to the military zone's management), the director of the Policy Department (subject to the remaining agencies and units) within 04 days from the date of receipt of the monitoring minutes medical regulations, is responsible for issuing the decision to issue the certificate of war invalids and preferential allowances and allowances according to Form No. 59, Appendix I of the Decree (hereinafter referred to as the decision to issue the certificate of invalids and subsidies, preferential allowances); at the same time, issue a certificate of invalids according to Form No. 102 of Appendix I of the Decree (hereinafter referred to as the certificate of war invalids) for cases with an injury rate of 21% or higher or issue a decision one-time disability allowance according to Form No. 61 Appendix IDecree (hereinafter referred to as the decision on one-time disability allowance) for cases with an injury rate of between 5% and 20%; transfer the dossier together with the decision to the requesting agency or unit for management and implementation of the incentive regime.

What is guidance on procedures for re-examination and assessment of the rate of bodily injury for war invalids who are in active service or have special injuries that recur in Vietnam? 

According to Article 8 of Circular 55/2022/TT-BQP guiding procedures for re-examination and assessment of the rate of bodily injury for war invalids and policy beneficiaries such as war invalids (hereinafter referred to as war invalids) who are in active service or have special injuries that recur and treat adjust the regime as follows:

The commander or political commissar of the military zone (subject to the military zone's management), the director of the Policy Department (the subject of the remaining agencies and units) within 10 days from the date of receipt of the monitoring minutes medical regulations, is responsible for promulgating decisions on adjustment of subsidies and preferential allowances according to Form No. 60, Appendix I of the Decree; transfer the dossier together with the decision to the requesting agency or unit for management and implementation of the incentive regime.
