What are regulations on the inspection and issuance of Certificate of inspection of fire prevention and fighting equipment in the People's Public Security in Vietnam?

Pursuant Article 7 of the Circular 06/2022/TT-BCA stipulating the inspection and issuance of Certificate of inspection of fire prevention and fighting equipment in the People's Public Security in Vietnam as follows:

1. Dossier and the receipt and handling of dossiers of application for inspection and issuance of Certificates of fire prevention and fighting equipment shall comply with the provisions of Clauses 5, 6, 7, 8 and 9 of Article 38 of the Decree No. 136/2020/ND-CP

In case the application file for inspection and issuance of the Certificate of inspection of fire prevention and fighting equipment is not within the competence to handle it, the officers and soldiers receiving the dossier shall record information in the form of refusal to accept and settle the application file according to Form No. 03 of the Appendix issued together with Circular No. 01/2018/TT-VPCP and return the application to the agency, organization or individual.

2. After receiving the dossiers as prescribed, the officers and soldiers receiving the dossiers shall make and record all information in the dossier handling process control sheet enclosed with this Circular and report to the competent persons to directly manage, approve and hand over the dossier to the assigned unit or department for settlement.

3. Leaders and commanders of units assigned to inspect and issue certificates of inspection of fire prevention and fighting equipment assign officers and soldiers to perform their tasks by the application process control sheet is issued together with this Circular.

4. Officers and soldiers assigned to handle dossiers shall take the following steps:

a) For the application for the Certificate of inspection of fire prevention and fighting equipment:

Check the composition of the application, the legality and the suitability of the documents included in the application according to the provisions of Points c and d, Clause 5, Article 38 of Decree No. 136/2020/ND-CP;

Check and compare the content of the fire prevention and fighting equipment inspection record, test results and documents included in the dossier with the provisions of technical regulations and standards or requirements on assurance of fire prevention and fighting safety;

Based on the results of examination and comparison of dossiers:

In case of proposal for settlement of dossiers: Draft Certificate of inspection of fire prevention and fighting means according to Form No. PC29, Appendix IX issued together with Decree No. 136/2020/ND-CP, written notice of charges print inspection stamps of fire prevention and fighting equipment (if any), report directly to leaders and commanders, and submit them to competent persons directly in charge for approval and signature. Components of the application for signing are specified at Points a, b, c, dd and l, Section 3 of the Appendix to the list of components of the dossier submitted for signing and promulgated together with this Circular;

In case of proposal to refuse to process dossiers: Draft a written reply on the results of settlement of dossiers of application for the Certificate of fire prevention and fighting equipment inspection, report to the leader and commander directly to submit to the competent person to directly manage, approve and sign. The components of the application file for signing are specified at Points a, b, d and point l, Section 3, in the Appendix to the list of components of the application for signing, issued together with this Circular;

b) For the application file for inspection and issuance of Certificate of inspection of fire prevention and fighting equipment:

Organize the sampling of fire prevention and fighting equipment and record the information on Form No. PC28, Appendix IX issued together with Decree No. 136/2020/ND-CP;

Draft notice of charge for inspection of fire prevention and fighting means, plan for testing of fire prevention and fighting equipment, report to direct leader and commander, and submit to competent person directly managing for approval and signing;

Carry out testing of fire prevention and fighting means:

In case the test results are satisfactory: Draft and record information on Form No. PC25, Appendix IX promulgated together with Decree No. 136/2020/ND-CP and comply with the provisions of Point a of this Clause. Components of the application file for signing are specified at Points a, b, c, dd, g, h, i, k and point l, Section 3, Appendix to the list of components to be submitted for signing together with this Circular;

In case the test results are unsatisfactory: The draft written response on the results of the settlement of the application for inspection and issuance of the Certificate of inspection of fire prevention and fighting equipment shall report to the leader and commander on duty. submit to the person competent to directly manage for approval and signature. Components of the application file for signing are specified at Points a, b, d, g, h, i, k and point l, Section 3, Appendix to the list of components of the dossier submitted for signing, issued together with this Circular;

c) After the certificate of inspection of fire prevention and fighting means or the written reply is approved and signed: Take number and stamp of the document as prescribed;

In case of issuance of Certificate of inspection of fire prevention and fighting means together with stamps of inspection of fire prevention and fighting means: Register number of stamps of inspection of fire prevention and fighting means of fire prevention and fighting equipment and fully record in the Certificate of inspection of fire prevention and fighting means; draft written notice to the agency or organization requesting the inspection and issuance of the Certificate of inspection of fire prevention and fighting means of the time of organizing the stamping of the inspection of fire prevention and fighting equipment;

d) Hand over the certificate of inspection of fire prevention and fighting equipment or a written reply on the results of the settlement of the application for inspection and issuance of the certificate of inspection of fire prevention and fighting equipment and fire fighting and the control sheet of the processing of records for the department that returns the results;

Coordinate with agencies and organizations requesting the inspection of fire prevention and fighting means and relevant functional units to organize stamping of fire prevention and fighting equipment according to regulations.

5. Prepare and store dossiers of issuance of Certificate of inspection of fire prevention and fighting equipment, dossier of inspection and issuance of Certificate of inspection of fire prevention and fighting equipment according to regulations on professional dossiers of Police people.
