Responsibility for Developing and Coordinating the Development of Firefighting Plans
According to Clause 3, Article 19 of Decree 136/2020/ND-CP (Effective from January 10, 2021), the content is stipulated as follows:
Responsibilities for developing and coordinating the fire-fighting plan:
- The Chairman of the People's Committee at the commune level, the head of the establishment under the management of fire prevention and fighting, and the owner of the motor vehicle with special requirements for fire prevention and fighting safety are responsible for organizing the development of the fire-fighting plan for the establishment with regard to residences, establishments, and vehicles using on-site forces and means within the scope of management (Form No. PC 17);
- The Chief of the District-level Police is responsible for organizing the development of the fire-fighting plan of the police for the establishments listed in Appendix II issued with this Decree and residential areas with a high risk of fire and explosion within the area assigned to perform fire prevention and fighting duties (Form No. PC 18);
- The Chief of the Provincial Fire Prevention and Fighting and Rescue Police Department is responsible for organizing the development of the fire-fighting plan of the police for the remaining establishments listed in Appendix II issued with this Decree, and the fire-fighting plan which requires mobilization of police forces, military, local agencies, organizations, and police forces of multiple provinces and centrally-run cities (Form No. PC 18).
When developing the fire-fighting plan, the police agency must notify the head of the establishment, the Chairman of the People's Committee at the commune level where there is a residential area with a high risk of fire and explosion, 03 working days in advance about the time of plan development and the necessary requirements for the plan development.
The Chairman of the People's Committee at the commune level where there is a residential area with a high risk of fire and explosion, and the head of the establishment specified in Appendix II issued with this Decree are responsible for providing the necessary documents and information related to the development of the fire-fighting plan as required by the police agency, arranging participants, and ensuring the conditions serving the development of the fire-fighting plan.
