Application for Issuance of a Fisheries Exploitation Permit Submitted to Which Agency?

Clause 1, Clause 2 Article 51 of the Fisheries Law 2017 stipulates the issuance of the Fishing License as follows:

1. The provincial People's Committee issues, extends, reissues, and revokes the Fishing License, except for the case specified in Clause 2 of this Article.

2. The Ministry of Agriculture and Rural Development issues, extends, reissues, and revokes the Fishing License for foreign organizations and individuals fishing in Vietnamese waters; and for Vietnamese organizations and individuals fishing outside Vietnamese waters.

=> The authority to issue the Fishing License belongs to the Provincial People's Committee or the Ministry of Agriculture and Rural Development depending on the specific case.

In your case, if the fishing activity is within Vietnamese waters, the license is issued by the Provincial People's Committee. If the fishing activity is outside Vietnamese waters, the license is issued by the Ministry of Agriculture and Rural Development.
