Is there a Circular regulating the rates, collection, payment, management and use of fees for exploiting and using environmental data in Vietnam?
On October 31, 2023, the Minister of Finance issued Circular 65/2023/TT-BTC regulating collection rates, collection, payment, management and use of fees for exploiting and using environmental data.
According to Circular 65/2023/TT-BTC does not regulate the exploitation and use of environmental data by state agencies for the following purposes:
- Exploit and use hydrometeorological information and data to:
+ Announce on mass media for non-profit purposes.
+ Serve natural disaster prevention and control, ensuring national defense and national security.
+ Exchange information with foreign countries and international organizations according to international treaties to which Vietnam is a member.
+ Other purposes as required by competent state agencies.
+ Serve planning activities according to the provisions of law on planning.
- Exploit and use hydrometeorological information and data for other purposes at the request of competent state agencies to perform the following activities:
+ Serve the activities of Party agencies, National Assembly, Government, and central-level socio-political organizations.
+ Serve investigation, adjudication, and dispute resolution activities at the request of investigation and adjudication agencies.
+ Serve the development of strategies, planning, and plans for socio-economic development of ministries, branches, and localities at the request of Ministers, Heads of ministerial-level agencies, and Chairman of the Provincial People's Committee.

What are principles for collection, management and use of natural resources and environment data in Vietnam?
In Article 5, Decree 73/2017/ND-CP stipulates the principles for collection, management and use of natural resources and environment data as:
The collection, management and use of natural resources and environment data are performed according to the following principles:
1. Ensure the accuracy, integrity, objectiveness and inheritance of data.
2. Collect and manage all sources of information and data from regulatory authorities, organizations and individuals.
3. Store and maintain data so as to ensure long-term and convenient use.
4. Systematically organize data to facilitate the use of data, increase efficiency and saving for the entire society, and improve the national competitiveness.
5. Data and information can be published and accessed in accordance with regulations of the Law on Access to Information, excluding information and data of the state secrets and restricted from accessing.
6. Data and information must be timely provided to serve the state management and meet the social-economic development demands as well as ensure national defense and security.
7. Data and information must be used for prescribed purposes with sources of information quoted in accordance with regulations of the laws on protection of state secrets and intellectual property.
8. Users of information and data must fulfill financial obligations in accordance with regulations of law.
