What are regulations on coordinating the provision of information about ships; passengers, luggage of passengers on entry, exit or in transit; Import and export goods at seaports in Vietnam?

Pursuant to Clause 1 Article 12 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating regulations on coordinating the provision of information about ships; passengers, luggage of passengers on entry, exit or in transit; Import and export goods at seaports in Vietnam as follows:

a) The Director of the Maritime Port Authority or the Director of the Inland Waterway Port Authority and the Director of the Sub-department of Customs shall coordinate with the Director of the seaport business enterprise or the Director of the inland waterway port enterprise to agree on the following information: Information provided, method and time limit for providing relevant information are as follows:

a.1) Request shipping lines or shipping line agents or port authorities to provide information: Type of ship, vessel name, ship's nationality, IMO number, ship call, number of voyages, number of crew on board, place departure, destination, place of transit, estimated schedule of ships and ships (hereinafter referred to as ships) exiting, entering, transiting according to the plan and changes in the schedule of ships leaving and arriving at the port after approved by the competent authority; information related to the list of crew members and crew members' luggage; list of checked baggage on the same trip;

a.2) Place and time of anchoring the ship in the waters in front of the port, the activities arising during the time of anchoring at the port (receiving petrol, repairing, moving, maintaining, maintaining, etc) ;

a.3) Wharf area for loading, unloading or loading goods for export, import or transit;

a.4) Wharf area to pick up and drop off passengers, the entrance and exit gates of passengers; passenger corridors;

a.5) Unusual risk information should be closely monitored.

b) In case of needing special information, the Customs authority or the Maritime Port Authority or the inland waterway port authority shall send a written request to the Director of the seaport business enterprise or the Director of the inland waterway port enterprise to provide such clearly information stating the purpose, type of information and scope of information use, time of provision, and information-providing agency shall:

b.1) Collect and process information and provide it at the request of the information requesting agency;

b.2) In case it is not possible to provide the requested information, it must notify the requesting agency in writing and clearly state the reasons therefor;

c) In the case of information in electronic form, the provision and sharing of information must be accurate, confidential and secure in the process of information sharing.

d) Time limit for providing information

d.1) For incoming seagoing ships, this shall be done within 02 hours after the port authority announces that the incoming ship has arrived at the pilot pick-up and drop-off position;

d.2) For seagoing ships on exit, it shall be done at least 01 hour before the ship exits;

d.3) For cargo, luggage and passengers, the time limit for providing information shall comply with agreements and coordination regulations at each border gate.

What are regulations on coordinating and sharing the use of infrastructure and electricity and water systems, information and telecommunications networks at seaports in Vietnam?

Pursuant to Clause 2 Article 12 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating regulations on coordinating and sharing the use of infrastructure and electricity and water systems, information and telecommunications networks at seaports in Vietnam as follows:

a) The Director of the Maritime Port Authority or the Director of the Inland Waterway Port Authority and the Director of the Sub-department of Customs shall coordinate with the Director of the seaport business or the Director of the inland waterway port enterprise to agree:

a.1) Arrange the area for gathering export and import goods; goods showing signs or signs of law violation pending handling;

a.2) Arrange areas for gathering and checking luggage of passengers on exit or entry;

a.3) Arrange physical inspection of goods in the port;

a.4) Regulations to limit the speed of means of transport in and out of the port area so that the identification camera system of the Customs authority works effectively; minimize the number of port ports for export and import goods; domestic goods must pass through a separate gate;

a.5) Design of premises, allocation and area of ​​functional areas in the port related to the activities of each party;

a.6) Change of design, construction or completion of installation;

a.7) There is a need to change (increase or decrease) due to the requirements of the professional work.

b) Allocate premises, headquarters, working area, interior arrangement, electricity and water system, information and telecommunications network in the relevant areas must comply with the following factors:

b.1) Specify the general ratio suitable to the actual total area;

b.2) Requirements for professional work and professional processes;

b.3) Procedures for operation, maintenance and maintenance of machinery and equipment for inspection and supervision of goods and luggage;

b.4) Organizational payroll, working equipment;

b.5) ​​Ensure logic and science, ventilation and convenience for the port's specific operation; avoid overlapping, congestion.

What are regulations on coordinating, sharing, using and operating systems, machinery and equipment to work and serve inspection and supervision at seaports in Vietnam?

Pursuant to Clause 3 Article 12 of the Joint Circular 63/2016/TTLT-BTC-BGTVT stipulating regulations on coordinating, sharing, using and operating systems, machinery and equipment to work and serve inspection and supervision at seaports in Vietnam as follows:

a) The Director of the Maritime Port Authority or the Director of the Inland Waterway Port Authority and the Director of the Customs Sub-Department shall coordinate with the Director of the seaport business enterprise or the Director of the inland waterway port business enterprise to reach agreement on the following matters:

a.1) Location of installation of surveillance camera system, machinery and equipment for work and inspection and supervision;

a.2) Regulations on general use and operation;

a.3) Related responsibilities;

b) Principles of sharing, using and operating systems, machines and equipment for work and for inspection and supervision:

b.1) Comply with the law, professional requirements, procedures for inspection, supervision and supervision of goods, passengers and ships;

b.2) Comply with the operating and maintenance procedures for systems, machines and equipment;

b.3) Convenient, well-ventilated, convenient for manipulation and use; avoid congestion, duplication;

b.4) Cost savings in terms of time, human resources and actual space for each port;

b.5) ​​Sharing of responsibilities among authorities;

c) The camera system to monitor the port areas is designed and installed to ensure:

c.1) Optimal for monitoring purposes, monitoring 24/24 the entire area and objects to be monitored; have technical features that meet the requirements of remote operation control, zoom in, out, and save images according to business requirements (minimum retention period, etc);

c.2) Connect with the Customs to serve the purpose of supervision at the isolation area, the wharf area for loading and unloading goods, and the warehouse to store the containers of exported and imported goods, the wharf area to welcome and drop off passengers, routes for transporting passengers, luggage and goods in and out of the port, the area of ​​workshops and warehouses for repair and maintenance of foreign ships;

c.3) Customs authorities can remotely control a number of surveillance cameras locally when necessary;

c.4) In order to meet special supervision requirements, the Director of the Customs Sub-Department and the Director of the port business enterprise agree to design and install additional surveillance cameras in a number of necessary areas;

c.5) Ensure against waste due to overlapping, duplication in design and installation.

d) Scanners of passengers' hand baggage and checked baggage

The Director of the Maritime Port Authority, the Director of the Inland Waterway Port Authority, the Director of the Customs Sub-Department agreed on:

d.1) Installation location of hand luggage scanners of passengers on exit or in transit at quarantined areas on exit or in transit;

d.2) The location of installation of the scanner for checked baggage on the same flight of exiting passengers is at the location behind the check-in baggage check-in area;

d.3) Installation position of hand luggage scanners of passengers on entry at the baggage claim area after the immigration procedures area;

d.4) Installation position of checked baggage scanners of passengers on entry at the baggage claim area;

d.5) The installation location of the scanner must ensure convenience for passengers, comply with the professional process and be suitable for the actual ground area;

d.6) The Director of the Customs Sub-Department shall be responsible for allocating human resources and organizing baggage screening to ensure strict compliance with regulations; does not cause congestion, meets quality and service standards.

d) Cargo container scanner

dd.1) Containers of exported, imported or transited goods must be scanned according to legal regulations, professional processes and inspection and supervision requirements of the Customs;

dd.2) The installation location of the container scanner must ensure convenience for the customs office's professional process and be suitable for the actual surface area of ​​the warehouse area;

dd.3) The Director of the Maritime Port Authority or the Director of the Inland Waterway Port Authority, the Director of the seaport business enterprise or the Director of the inland waterway port business enterprise and the Director of the Sub-department of Customs agree on the Analyze the area of ​​the scanner to screen export containers to ensure that there is no congestion, convenient ventilation, and strict management.

g) Radiation detection test system

g.1) The Director of the Maritime Port Authority or the Director of the Inland Waterway Port Authority, the Director of the seaport business enterprise or the Director of the inland waterway port business enterprise, and the Director of the Sub-Department of Customs agree on the position position to install the radioactive detection inspection system in accordance with current regulations in accordance with the professional process of the Customs; ensure security, safety and quality, standards of maritime services; not cause congestion, hinder business;

g.2) A radioactive detection inspection system is installed to ensure radioactive detection of exported and imported goods; baggage and passengers on entry and in transit.

h) The Director of the Port Authority and the Director of the Sub-department of Customs agree with the Director of the seaport and inland waterway port business to arrange the premises for the installation of the radiation detection and inspection system in accordance with regulations of law. The provisions of the Joint Circular No. 112/2015/TTLT-BTC-BKHCN dated July 29, 2015 of the Minister of Finance and the Minister of Science and Technology guiding the coordination and handling mechanism in the inspect and detect radioactive substances at border gates; consistent with the professional process of the Customs; ensure security, safety and quality, standards of maritime services; no congestion.
