Responsibilities of Agencies, Organizations, Units, and Enterprises, and Organizations in the Non-State Sector in Anti-Corruption Activities
On November 20, 2018, the National Assembly of the Socialist Republic of Vietnam, Session XIV, at its 6th meeting, passed the Law on Anti-Corruption No. 36/2018/QH14 (referred to as the Anti-Corruption Law 2018).
The Anti-Corruption Law 2018 provides regulations on the prevention and detection of corruption; handling corruption and other acts in violation of the law on anti-corruption.
According to the provisions of Article 4 of the Anti-Corruption Law 2018 (effective from July 1, 2019), the responsibilities of agencies, organizations, units, and enterprises, as well as non-state sector organizations in preventing and combating corruption, are specifically stipulated as follows:
- Agencies, organizations, and units, within the scope of their duties and powers, have the following responsibilities:
- Implement measures to prevent corruption; promptly detect and handle according to their authority and recommend that competent state agencies handle corruption within their agency, organization, or unit; and implement other provisions of the law on anti-corruption;
- Protect the legitimate rights and interests of individuals who reflect, report, denounce, inform, or provide information about corrupt acts;
- Promptly receive and handle complaints, reports, denunciations, information, and notifications about corrupt acts;
- Timely provide information and fulfill the requests of competent agencies, organizations, units, or individuals during the process of detecting and handling corruption.
- Enterprises and non-state sector organizations have the following responsibilities:
- Implement measures to prevent corruption; promptly detect, report, and cooperate with competent state agencies to prevent and handle corruption occurring within the enterprise or organization according to the law and the charter, rules, and regulations of the enterprise or organization;
- Promptly provide information about corrupt acts of individuals in positions of power, and cooperate with competent state agencies to prevent and handle corruption.
