Acts Prohibited for Individuals with Positions and Authority in Agencies, Organizations, and Units
On November 20, 2018, the National Assembly of the Socialist Republic of Vietnam, Legislature XIV, at its 6th session, passed the Anti-Corruption Law No. 36/2018/QH14 (referred to as the Anti-Corruption Law 2018).
The Anti-Corruption Law 2018 stipulates the prevention and detection of corruption; handling of corruption and other acts violating the law on anti-corruption.
According to Clause 2, Article 20 of the Anti-Corruption Law 2018 (effective from July 1, 2019), persons holding positions of power in agencies, organizations, and units are prohibited from performing the following acts:
- Engaging in harassment in the resolution of work;
- Establishing, participating in the management, and operation of private enterprises, limited liability companies, joint-stock companies, partnerships, cooperatives, except as otherwise provided by law;
- Advising businesses, organizations, and other individuals domestically and abroad on matters related to state secrets, professional secrets, work under jurisdictions to resolve or participate in resolving;
- Establishing or holding managerial or operational positions in private enterprises, limited liability companies, joint-stock companies, partnerships, cooperatives in fields they were formerly responsible for managing within a specific period prescribed by the Government of Vietnam;
- Illegally using information from the agency, organization, or unit;
- Other acts that persons holding positions of power are prohibited from performing according to the Law on Cadres, official, the Law on Public Employees, the Law on Enterprises, and other relevant laws.
