What is the Penalty for Incorrectly Naming the Author of a Literary Work on Television?
Section 2 Article 19 of the 2005 Intellectual Property Law stipulates the protection of moral rights, including the right:
- To have the true name or pseudonym on the work; to be mentioned by the true name or pseudonym when the work is published, used;
At Section 1 Article 9 of Decree 131/2013/ND-CP, it is stipulated as follows:
- A fine from 2,000,000 VND to 3,000,000 VND for the act of using a work without citing the true name, pseudonym of the author, the name of the work, or incorrect citation of the true name or pseudonym of the author, the name of the work on the copy of the work, audio recording, video recording, broadcast program.
Thus, incorrectly citing the name of the author of a literary work on television can result in a fine from 2 million to 3 million VND.
In addition, this act is also subject to the following remedial measures:
- Mandatory public correction of incorrect information on mass media;
- Mandatory correction of the author's name in a broadcast program that contains incorrect information about the author's name.
